A RESOLUTION ESTABLISHING A PROCEDURE TO SELL CERTAIN REAL PROPERTY OWNED BY UNIFIED GREELEY COUNTY, KANSAS, PURSUANT TO K.S.A. 19-211(b).

 


WHEREAS, K.S.A. 19-211(b) allows the governing body of a County to adopt a resolution establishing a methodology for the disposal of property, including real property, that includes the notification of the public of the property to be sold, the description of the property, and the method of sale; 

 


WHEREAS, Unified Greeley County, Kansas owns certain real property which it desires to sell, described as follows:

 


Surface rights only to the Northwest Quarter (NW/4) of Section Three (3), Township Eighteen (18) South, Range Forty (40) West of the 6th P.M., Greeley County, Kansas, LESS AND EXCEPT a tract of land more particularly described as follows:

A portion of the South Half of the Northwest Quarter (S/2 NW/4) of Section Three (3), Township Eighteen (18) South, Range Forty (40) West of the 6th P.M., Greeley County, Kansas, being more particularly described as follows:

Considering the West line of the Northwest Quarter of said Section 3 to bear an assumed bearing of North 00̊02’40” West with all bearings contained herein relative thereto.

BEGINNING at the West Quarter corner of said Section 3; thence along the West line of the Northwest Quarter of said Section 3, North 00̊02’40” West 723.64 feet; thence South 65̊30’24” East 269.76 feet; thence South 68̊35’16” East 376.30 feet; thence South 87̊42’30” East 1231.97 feet; thence South 01̊04’04” East 253.06 feet; thence South 89̊09’48” East 830.13 feet to the East line of the Northwest Quarter of said Section 3; thence along said East line South 00̊10’54” East 148.59 feet to the Southeast corner of the Northwest Quarter of said Section 3; thence along the South line of the Northwest Quarter of said Section 3, South 89̊45’14” West 2661.48 feet to the point of BEGINNING.

LESS AND EXCEPT Seller’s reservation of water rights (Water Right Nos. 10944, 16269 and 23020) and mineral interests and rights; 

(LESS AND EXCEPT Seller’s reservation of a permanent and perpetual easement for municipal water well sites that may to be selected by Unified Greeley County with consultation of Owner, including the right egress and ingress, and the right to drill, complete, operate, maintain, repair, and replace wells on any well site; and

LESS AND EXCEPT All easements and rights of way, whether recorded or not, and all mineral conveyances and oil and gas leases of record.

 


WHEREAS, the Board of Supervisors of Unified Greeley County, Kansas, desires to establish a procedure, pursuant to K.S.A. 19-211(b), for the sale of the above-described real estate.

 


NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF UNIFIED GREELEY COUNTY, KANSAS, as follows:

 


1. The Board of Supervisors directs the Unified Clerk to publish in the official newspaper for three consecutive weeks a “Notice of Intent to Sell Real Property” with reference to the above described real property.

 


2. Said Notice shall describe the method of sale as an OPEN BID process with the following guidelines and procedures:

 


A)   Opening minimum bid is $1,800.00 per acre.  Bid increments shall be a minimum of $50.00 per 

acre, unless waived by the Board of Supervisors.

B)   The property is to be sold on a per acre basis. The tract for sale contains 137.09 acres more or less.

C)   All bids shall be made on the Bid Sheet form available from the Unified Greeley County — Municipal Service District Office.

D)   Bids will be received in person or by email at the Unified Greeley County – Municipal Service District Offices (City Hall) - 508 Broadway -Tribune, Kansas 67879 (email: cityoftribune@wbsnet.org) until Friday, September 5, 2025, at 4:00 p.m. MDT.

E)   All bids shall be open to inspection by the public during normal business hours of the Unified Greeley County — Municipal Service District Office, which is 8:00 am to 4:00 p.m. MDT, Monday through Friday.

F)   To be considered a valid bid, the bid must be on the Bid Sheet form, be in an amount that is at least the minimum opening bid, and exceed any previously submitted valid bid by the minimum bid increment of $50.00 per acre.

G)   Only those persons who have submitted a valid bid prior to 4:00 p.m., Friday, September, 2025, will be allowed to place additional open bids to the Board of Supervisors at the regularly scheduled meeting commencing at 1:00 p.m., Monday, September 8, 2025.  The open bid process at the Board of Supervisors meeting will begin at approximately 1:05 p.m. and continue until such time as is closed by a majority vote of the Board of Supervisors. 

H)   The Board of Supervisors reserves the right to reject any and all bids and waive informalities.

I)   The successful bidder will be required to enter into a real estate purchase contract immediately following the close of bids by the Board of Supervisors, and tender 10% of the sum of the successful bid as earnest money.  A copy of the contract will be available from the Municipal Service District Office.  Unified Greeley County will provide title insurance to the buyer in the amount of the purchase price with the premium to be paid one-half by Unified Greeley County and one-half by the buyer.  The real estate taxes for 2025 shall be prorated to date of Closing with Unified Greeley County paying all said taxes up to date of Closing and the buyer paying all said taxes from and including date of Closing. Possession is subject to the current cash lease which is to terminate on May 31, 2026.

J)  Unified Greeley County shall reserve all water and mineral rights, as well as a permanent and perpetual easement for municipal water well sites that may to be selected by Unified Greeley County with consultation of Owner, including the right egress and ingress, and the right to drill, complete, operate, maintain, repair, and replace wells on any well site.

K)   Any bid from a person or entity who is not current on all property taxes and special assessments in Unified Greeley County, or from a shareholder, member, officer or director of such an entity, will be rejected.

L)   Each potential bidder is responsible for conducting their own independent inspections and due diligence concerning pertinent facts about said real property.

 


3. The Bid Form attached hereto is approved for use in the bid process for the sale of the subject real property.
